DETROIT AND ST. CLAIR SHORES POLICE SERGEANTS CHARGED WITH ARMED ROBBERY AND OTHER FELONIES

Prosecutor Kym L. Worthy has charged Detroit Police Sergeant David A. Pomeroy, 47, and St. Clair Shores Police Sergeant Michael Notoriano, 42, with felonies that occurred on July 21, 2013 at approximately 4:45 p.m.
Allegations

On July 20, 2013 at approximately 9:30 p.m. at a gas station located on the 14400 block of Kercheval in the City of Detroit, Notoriano's daughter was robbed of her iPhone. The phone was equipped with a "find your phone" application. On July 21, 2013, the phone was traced to a location on the east side of Detroit. While off-duty, travelling in a pick-up truck, Pomeroy and Notoriano approached a car containing three Detroit males, aged 26, 27, and 28. The two officers confronted the men at gunpoint. Pomeroy took a handgun and the iPhone from the vehicle and kept watch while Notoriano took $300 and a bag of marijuana from the 28 year-old's pocket. Before releasing the 28 year-old, Sergeant Notoriano struck him in the face with a handgun. The officers fled from the area in the truck.

Further details regarding the subsequent criminal investigation will be presented in court at the preliminary examination.

Charges for David Pomeroy

Pomeroy has been charged with: Armed Robbery, two counts of Unlawful Imprisonment, Larceny of a Firearm, Willful Neglect of Duty (Exercise of Unlawful Procedure), and two counts of Failure to Uphold the Law (Unlawful Search, Seizure and Detention).

Charges for Michael Notoriano

Notoriano has been charged with: Armed Robbery, two counts of Unlawful Imprisonment, two counts Felonious Assault, two counts of Ethnic Intimidation, Felony Firearm, Willful Neglect of Duty (Exercise of Unlawful Procedure), and two counts of Failure to Uphold the Law (Unlawful Search, Seizure and Detention).

The Defendants are expected to be arraigned today at 2:30 p.m. before Magistrate Sidney Barthwell in the 36th District Court.

DETROIT MAN CHARGED IN ROBBERY OF DAUGHTER OF ST. CLAIR SHORES POLICE SERGEANT

Prosecutor Kym L. Worthy has charged Dwayne Weathington Jr., 24, of Detroit, in connection with the unarmed robbery and assault of the 16 year-old daughter of St. Clair Shores Police Sergeant Michael Notoriano, that occurred on July 20, 2013 at approximately 9:30 p.m. at a gas station located on the 14400 block of Kercheval in the City of Detroit.

It is alleged that the 16 year-old female rode her bicycle with a male friend to the gas station. While there, Weathington pushed her off her bicycle and grabbed her by the backpack. While dragging her on the ground, he grabbed the iPhone from her hand and left the scene on foot.

The iPhone had a "find your phone" application which showed that the phone was located in the vicinity of St. Clair and I-94. On July 21, 2013 at 4:45 p.m., the phone was retrieved by Sergeant Notoriano, while he was assisted by Sergeant Pomeroy.

Weathington has been charged with Unarmed Robbery and Aggravated Assault. Arraignment details are not available at this time.
