Detroit Man Charged in Home Invasion and Shooting of 72-year-old Female on Sussex

Prosecutor Kym L. Worthy has charged Terry Lyons, 22 (11/23/90) of Detroit, in connection with a home invasion and non-fatal shooting of a 72-year-old female that occurred on February 8, 2013, at 5:00 a.m. at her home located in the 15000 block of Sussex in Detroit. On February 7, 2013, she locked and secured her home before going to bed and on February 8, 2013, she was awakened by an intruder in her home. Shortly thereafter she heard gunshots and felt pain.

The victim called the police and their investigation lead to the arrest of Lyons the same day. The victim was transported to a local hospital for treatment.

Lyons was arraigned on Sunday, February 10, 2013 on the following charges: Assault with Intent to Murder, Home Invasion 1st Degree, Possession of Burglar's Tools, Felonious Assault, and Felony Firearm. The defendant received a $500,000 cash/surety bond and has a preliminary examination scheduled on February 19, 2013, at 9:00 a.m.

Teen Brothers Charged in Armed Robbery of Utility Workers

Prosecutor Kym L. Worthy has charged Niko Brown, 17 (DOB 3/2/95), and his brother Devontay Brown, 16 (DOB 7/15/96), in connection with the February 7, 2013 armed robbery of two male utility workers who were working on a light pole located at the corner of Cloverlawn and Schoolcraft that occurred at 9:00 p.m. It is alleged that Niko Brown was armed with a weapon and accompanied by Devontay Brown, when they robbed the men of their money. After the defendants took the money, it is further alleged that they attempted to rob one of the workers of a phone while Niko Brown placed a weapon to his head. The other worker was able to retrieve a weapon, fired shots and wounded both defendants. Detroit police officers were called to the scene and discovered the defendants wounded nearby. They were conveyed by EMS to a local hospital for treatment.

Niko Brown has been charged with Armed Robbery and Felony Firearm. Devontay Brown is a juvenile who has been waived and will be tried as an adult on the charge of Armed Robbery. They were arraigned in the hospital on Tuesday, February 12, 2012, and their preliminary examination is scheduled for February 25, 2013. The bond for Niko Brown is $300,000 cash or surety. Bond for Devontay Brown is $100,000 cash or surety. Please contact the Detroit Police Department for photographs of the defendants.

Prosecutor Worthy to Appear on NBC's Rock Center with Brian Williams on February 15, 2012 at 10:00 PM

NBC Reporter Kate Snow will preview the piece on the Today Show on Thursday, February 14, 2013, during the 7:30 AM to 8:00 AM segment of the show.

Prosecutor Kym L. Worthy will be interviewed by reporter Kate Snow on NBC's Rock Center with Brian Williams at 10:00 p.m. on Friday, February 15, 2013. The show will focus on the 11,303 untested rape kits discovered in August of 2009 during a tour of a Detroit Police Department property storage warehouse. The piece will also focus on the work of the Detroit Sexual Assault Kit Action Research Project to address the problem and create a national protocol for other jurisdictions that encounter this issue across the nation.

The research project is funded by a grant awarded by the National Institute of Justice In April of 2011. The collaborative partners on the grant are: the Wayne County Prosecutor's Office, the Detroit Police Department, the Michigan State Police Crime Lab, Michigan State University, the Michigan Domestic Violence and Sexual Assault Prevention and Treatment Board, the Wayne County Sexual Assault Forensic Examiners, YWCA Interim House, the Prosecuting Attorneys Association of Michigan and the Joyful Heart Foundation

Juvenile Male Accomplice Charged in Robbery of King High School Basketball Coach

No Charges for Basketball Coach that Acted in Self-Defense

On Friday February 1, 2013, at approximately 7:30 p.m. in the parking lot of Martin Luther King High School located at 3200 East Lafayette, a 70-year-old male basketball coach was leaving the school with two female basketball players when he was accosted by two teenage males as he unlocked the door to his car. As the coach approached the driver's side of his car, a 16-year-old male armed with a gun and a 15-year-old male, both of Detroit, approached Robinson and ordered him not to move. It is alleged that the 15-year-old tugged at a chain Robinson was wearing. At the same time, the 16-year-old pointed a gun toward the two females who were on the passenger side of the coach's car. The females were instructed by the 16-year-old to leave the area and they ran toward Lafayette and were unharmed.

The coach is a Detroit police reserve officer with a concealed pistol license who was armed with a registered concealed handgun. While he was being robbed at gunpoint, he pulled out his handgun and fired at the 15-year-old and the 16-year-old. The 16-year-old male was fatally shot and discovered by the police near the scene of the robbery. It has been determined that the coach acted in lawful self-defense and he will not be charged.

"The Wayne County Prosecutor's Office will not charge the basketball coach with any crime. This case is a textbook example of lawful self-defense. The coach is a victim, so we are charging the 15-year-old accomplice in this case. What is left here is absolutely tragic by any standard," said Prosecutor Worthy.

The 15-year-old juvenile male is being held at the Juvenile Detention Center (JDC). He is charged with two counts of Armed Robbery and two counts of Assault with Intent to Rob While Armed, and will be adult designated. Upon conviction, an adult designation gives the judge three options: 1) to sentence the defendant as a juvenile; 2) to have a blended sentence as juvenile and adult; 3) or to sentence the juvenile as an adult. His preliminary hearing is scheduled for Saturday, February 16, 2013 at 9:00 a.m. at JDC located at 1326 Saint Antoine in Detroit.

Joseph Gentz - Convicted in the murder of Jane Bashara. His sentence date was re-scheduled today; it will take place on Tuesday, February 19, 2013, at 9:00 a.m. before Judge Vonda Evans.
